The Australian Competition and Consumer Commission (ACCC) has launched proceedings against Meta in the Federal Court over the publication of cryptocurrency scam advertisements featuring public figures on Facebook.

Meta is alleged to have engaged in false, misleading or deceptive conduct by publishing the scam ads in breach of the Australian Consumer Law or the Australian Securities and Investments Commission (ASIC) Act.

The ACCC claimed that the Facebook ads promoted investment in crypto or money-making schemes that were actually scams and gave the impression of being associated with public figures who had not provided approval or endorsement, including David Koch and Dick Smith.

When clicking on the scam ads, the ACCC said that users would be directed to a fake news story featuring quotes attributed to the public figure depicted in the Facebook ad.

Individuals were then invited to sign up to the fake scheme, and those that did experienced “high pressure tactics” from scammers to convince them to deposit money, the ACCC found.

The consumer watchdog said it was aware of one person who had lost over $650,000 due to a scam being falsely advertised as an investment opportunity on Facebook.

“The essence of our case is that Meta is responsible for these ads that it publishes on its platform,” explained ACCC chair Rod Sims.

“It is a key part of Meta’s business to enable advertisers to target users who are most likely to click on the link in an ad to visit the ad’s landing page, using Facebook algorithms. Those visits to landing pages from ads generate substantial revenue for Facebook.”

The ACCC claimed that Meta was aware of the scam ads but did not take sufficient steps to address them, even after receiving reports from the figures depicted in the ads.

“Meta should have been doing more to detect and then remove false or misleading ads on Facebook, to prevent consumers from falling victim to ruthless scammers,” said Mr Sims.

“Apart from resulting in untold losses to consumers, these ads also damage the reputation of the public figures falsely associated with the ads.”

The ACCC also alleged that Meta aided and abetted or was knowingly concerned in false or misleading conduct and representations by the advertisers.

The consumer watchdog claimed that Meta’s technology enabled the scam ads to be targeted at those users most likely to engage with them and that the company failed to prevent the publication of other similar crypto scam ads on its pages or warn its users.

A major bank has warned individuals and businesses to be on the lookout for scammers.

Australians have been urged to remain vigilant to a potential spike in scams as a result of the recent flooding events in Queensland and NSW.

Westpac said it had issued the warning to individuals and businesses as a result of scammers often using similar events to take advantage of those impacted as well as those trying to offer assistance.

“Time and time again, following a significant event or natural disaster, we see an increase in people being duped by scams, for example, after the devastating 2020 bushfires,” said Westpac general manager of fraud prevention and financial crime Chris Whittingham.

“This is a tactic fraudsters have continued to adopt throughout the pandemic where scams have almost tripled, exploiting the hearts and wallets of those experiencing hardship, or who have sought out items in high demand, like Rapid Antigen Tests.”

The bank said that scammers were exploiting the recent floods to steal the money and information of unsuspecting individuals and businesses through websites, emails and phone calls.

“With the current floods crisis, scammers will try to take advantage of Australians’ generosity and support by setting up fake donation sites, or even posing as insurers, businesses or government organisations offering help to the victims themselves,” said Mr Whittingham.

“We are urging people to be on high alert to the possibility of scams and closely check that any websites or charitable organisations are legitimate before sending funds or your personal information.”

Aussies have been encouraged to remain cautious about unexpected calls and emails that claim to be from a reputable organisation and to contact them on a public number when in doubt.

The bank also noted that links in emails requesting payment, personal information or bank logins should never be clicked on.

Individuals and businesses who think they may have fallen victim to a scam should stop all contact with scammers and notify their financial institution immediately.

“The sooner your bank is notified, the better chance at recovering any lost funds,” Westpac said.

Scams can also be reported to the federal government’s ScamWatch website.

In an address to the AICD Governance Summit on Thursday, 3 May, Mr Longo revealed that there has been a concerning increase in scams in recent years, including those that relate to crypto-assets.

“Over the past three years, scams have risen from 15 per cent to 35 per cent of all reports of misconduct made to ASIC, indicating that this is an increasingly significant issue for consumers,” Mr Longo said.

“With hundreds of millions lost per year to scams, government agencies have observed a rise in investment and other scams during the pandemic, while largely unregulated crypto-assets are used increasingly to funnel money to scammers overseas.”

Mr Longo said ASIC is committed to tackling the issue in 2022 through working with other regulators, industry and social media platforms to disrupt scams and addressing the “deceptive” promotion of riskier asset classes, such as crypto.

In ASIC’s quarterly update last month, Mr Longo said the regulator is committed to raising awareness on new and continuing regulatory obligations, including the growth of crypto-asset adoption.

“The adoption of crypto-assets by Australians seeking better investment yields continued to grow during the quarter,” Mr Longo said.

“Investor protection lay at the core of our actions and advice in this space.”

The guidance surrounding cyber crime has been developed by the ATO and the Tax Practitioners Board.

New guidelines on identity verification have been developed by the Australian Taxation Office (ATO) and the Tax Practitioners Board (TPB) in an effort to combat cyber crime.

The ATO and TPB warned that victims of cyber crime could suffer serious financial consequences regardless of whether they are an individual, small business or large company.

“We are increasingly concerned that criminals are committing tax refund fraud by stealing data and impersonating taxpayers,” said ATO Deputy Commissioner William Day.

“Protection of privacy and information is important for all Australians. Tax practitioners have a trusted role and these new guidelines will further help them to meet their obligations to secure the personal and financial details of their clients.”

The new proof of identity guidance from the TPB aims to help tax practitioners verify the identity of their clients and therefore reduce the risk of identity theft and tax fraud.

In addition, the complementary strengthening client verification guidelines released by the ATO are targeted at tax practitioners using the online services for agents system or practitioner lodgment services through software.

“In a period where cybercrime is becoming increasingly prevalent, maintaining best practices for client verification is vital,” said TPB chair Ian Klug.

“The TPB guidelines outline appropriate requirements for verification – this includes defining the documents to be sighted, maintaining records and recommendations about achieving remote verification of clients.”

The ATO and TPB said they had consulted extensively with industry and tax practitioners during the development of the guidelines, which are set to become the minimum standards in the future.

Mr Klug added that proof of identity systems had already been implemented by many tax practices as part of their risk management and governance processes.

“I encourage other tax advisers to review and update their systems as soon as possible,” he said.

“After an appropriate time for education, consultation, and transition, we will formalise these guidelines and their date of effect.”

Experts are warning deal-hungry consumers to beware scammers as the holiday season arrives.

Scammers are getting smarter all the time, but there are still a few tricks you can use to stay ahead of them.

KnowBe4 security awareness advocate Jacqueline Jayne outlined five common types of scam that crop up during the holiday season.

The first of these usually involved the scammer posing as a representative of a charity, and attempting to get one over on potential victims.

“The holidays are traditionally the time for generosity and giving. It’s also the time that the cybercriminals try to trick money out of people that mean well,” she explained.

To avoid being scammed, she recommends those looking to donate to a charity only do so via an official website or phone number. 

Another big scam seen during the holiday season involves discounted gift cards.

Ms Jayne recommended steering clear of any deals that sound too good to be true, especially if you encounter them on social media.

The same goes for social media promotions that emphasise the stock or time-limited nature of an offer.

"Never click on links in emails or popup ads on websites or social media pages with very deep discounts or seemingly incredible offers,” she said.

Another thing to steer clear of is mobile shopping apps.

Ms Jayne noted that shady shopping apps can sometimes bypass controls built-in by the app store, and recommended consumers do their research before downloading anything new to their personal devices.

“Be wary of apps from unknown developers or those with limited/bad reviews,” she said.

Ms Jayne predicted that holiday shoppers are likely to be bombarded by an increase of emails and SMS notifications that claim to be from delivery services like DHL, FedEx and Australia Post.

However, she warned consumers to remain vigilant and only rely on official websites to confirm or track deliveries.

“If in doubt, call them!”

For those looking for an extra layer of protection from scammers, Ms Jayne recommended considering a virtual private network (VPN) or a third-party payment service such as PayPal, Apple Pay or Google Pay.

The Australian Federal Police has prevented cyber criminals from stealing nearly $24 million from superannuation accounts, the AFP confirmed in a statement on Monday (29 November).

During an operation in May this year, the AFP worked with 20 super funds and facilitated the remediation of more than 25 managed super information systems that had been targeted by cyber criminals.

This prevented $23.9 million from being taken out of 681 super member accounts and 35 employer accounts.

“The AFP, with our partners, are disrupting highly-sophisticated criminal syndicates both onshore and offshore,” said AFP assistant commissioner Justine Gough.

“The AFP has investigated a large range of cybercrime methods with business email compromise, intrusion against industry/government and malware at the top of the list.”

As part of Operation Zinger, the AFP and an unnamed foreign law enforcement agency were able to identify an online criminal marketplace selling cyber crime software.

More than 500,000 online credentials were found to have been compromised, with the AFP using data science operations to help determine victims and offenders.

Eight individuals have been charged with 21 cyber crime offences as part of the AFP’s 163 disruption activities during the past financial year.

Other operations conducted by the AFP this year have included working with a major bank to prevent a Canberra property buyer from losing more than $1 million that was mistakenly transferred to a cyber criminal as part of a scam.

The AFP was also able to alert NAB to another case involving an elderly woman who transferred a $500,000 property settlement in response to a scam email that she believed was from her solicitor. Over 80 per cent of her funds were able to be retrieved.

Assistant commissioner Gough will lead the new Joint Policing Cybercrime Coordination Centre (JPC3) when it becomes operational in March next year and will become the AFP’s first full-time executive dedicated to tackling cyber crime.

“This AFP-led cybercrime centre will be cutting edge, and will ensure Australia is leading the world on cyber security,” said Home Affairs Minister Karen Andrews.

“Australians work hard for their money and the AFP is working tirelessly to prevent cyber criminals from scamming, stealing, and defrauding them.”
