The watchdog’s decision is based on findings that suggest that binary options have caused significant losses for retail clients.

In fact, ASIC reviews in 2017 and 2019 found that approximately 80 per cent of retail clients lost money trading binary options because of the nature of these financial products, including their ‘all or nothing’ payoff structure, their short contract duration, and negative expected returns.

As such, as of 3 May, the issue and distribution of binary option to retail clients will be banned.

According to commissioner Cathie Armour, “Binary options’ product characteristics make them incompatible with investment or risk management use by retail clients.”

“ASIC’s product intervention order will protect retail investors from these harmful products at a time of heightened vulnerability,” the commissioner clarified.

Following ASIC’s warning in April 2019 against providing unlicensed or unauthorised services to clients located in several foreign jurisdictions, the size of the binary market in Australia is believed to have reduced significantly.  

Australian retail clients are estimated to have made net losses of more than $6.7 million in 2019, compared with $490 million in 2018.

ASIC’s binary options ban brings Australian requirements into line with prohibitions in force in comparable markets and follows the commencement on 29 March 2021 of ASIC’s product intervention order imposing conditions on contracts for difference offered to retail clients.

The order will remain in force for 18 months, after which it may be extended or made permanent. Civil and criminal penalties apply to contraventions of the product intervention order.

What is a binary option?

A binary option is a cash-settled, over-the-counter (OTC) derivative entered into by two counterparties – the binary option issuer and the client. 

The ‘all-or-nothing’ payout under a binary option contract is determined by the occurrence or non-occurrence of a specified event in a defined time frame. This can include an event related to movements in the price of a financial product or a market index or an economic event.

During a recent seminar, crypto specialists Apollo capital and gold traders Meld Gold discussed how investors can not only store their wealth, but get ahead through buying either gold or digital currencies. 

Why you should invest in gold over bitcoin

Meld Gold’s founder Michael Cotton believes that gold is the only true store of wealth against inflation, with crypto assets such as bitcoin (BTC) simply trying to recreate the properties that make gold unique. 

“If we want to be harsh, BTC plagiarised gold’s natural DNA and recreated it on chain. In reality, it’s a really hard thing to actually copy the physical attributes of gold. Gold is understood and globally accepted across the world. Gold is the only asset in the world accepted at local currency prices,” he told investors. 

Mr Cotton points out that due to gold being universally accepted and having a relatively stable price compared with crypto currencies, it acts as a store of wealth for investors against inflation. 

“In terms of a currency, the volatility of BTC makes it very hard for the average person to use it as a currency in their lives.

“If you have your pay cheque in BTC, for example, and by the end of the week it’s halved in value and you can’t cover your bills, that is a real issue.”

“So, while that volatility makes for an amazing opportunity for investing, but it does mean it’s hard to use as currency. Even for a concept of storing BTC, having to constantly adjust the price of it is a real investment issue,” Mr Cotton explained.

He also highlighted that gold over the last 15 years has seen an average 10 per cent increase in price, meaning it has outperformed the sharemarket, bonds and property while acting as a store of wealth. 

Why you should invest in bitcoin over gold 

Apollo Capital’s chief investment officer, Henrik Andersson, told investors that if they had started a portfolio with equal weights in BTC and gold, that BTC would become the larger share quickly due to its superior performance.

He also noted that bitcoin has a more finite supply compared with gold, especially as humans look to expand mining operations across the universe. 

“When it comes to gold, maybe not an unlimited supply but pretty close to it when a single astroid can have 700 quintillion worth of gold, so that is 700 billion billion dollars worth of gold.

“If that gold was brought back to earth, everyone would get $92 billion. So, only things that are scarce and have utility have value, and gold is not limited in supply.”

While highlighting space mining is unlikely to start up tomorrow, he said it could be an issue for investors over the coming decades. 

Mr Andersson also opined that BTC is the more secure asset class, even though BTC’s heightened security has meant up to 2 million coins have been lost forever. 

“With computer science, we have unprecedented deep security,” he said. 

“With most technology, it’s easier to attack than defend, but cryptography is very different. It’s much easier to secure than attack,” he said. 

Which way are investors leaning?

Australian cryptocurrency and digital assets exchange BTC Markets has revealed that more Australians now invest in cryptocurrencies like bitcoin than precious metals like gold and silver.

Commenting on the findings, BTC Markets CEO Caroline Bowler said she is not surprised that more Australians now invest in cryptocurrency than fixed income, annuities or commodities.

“Digital assets and cryptocurrencies are becoming increasingly popular among Australian investors of all ages.

“In the last 12 months, we have seen a shift from 25-45-year-old males to a much broader age group, particularly early retirees who are interested in diversifying their investment portfolio and are catching up with this fastest-growing asset class.”

The survey found that one in three (33 per cent) crypto investors made their first investment in bitcoin or other cryptocurrencies after the stock market crash led by the COVID-19 pandemic in March 2020.

Advocates for climate action have marched in Canberra, demanding that the government remove its plan for a fossil fuel-dependent economic recovery.

Prime Minister Scott Morrison has previously outlined his vision for a gas-led economic recovery from the coronavirus pandemic, declaring that the cheap and reliable power will help boost the economy. 

However, members of the Peoples Climate Assembly (PCA) have marched on the lawns of Parliament House on the first sitting day of the year to challenge the government’s “nonsensical” decision to favour gas over renewable energy. 

“While countries and corporations around the world are abandoning fossil fuels, we have to ask ourselves why our government is ignoring the very clear science and rapidly shifting market forces,” PCA spokesperson John Smith said.

Mr Smith said the bushfire crisis rapidly gave way to storms and floods, and the COVID-19 pandemic which, in addition to far-reaching and tragic social and economic disruption, broke the enormous momentum that climate rallies had achieved.

“On Tuesday, the people will gather again to tell the government there is no more free ride,” said Mr Smith.

“We will not remain silent as the government sets us on a dangerous path.”

Along with the rally, the PCA has started a petition to the House of Representatives, where Independent MP Andrew Wilkie will call the House to reject the gas-led recovery and instead develop a COVID recovery package that stimulates green jobs.

“A ‘gas-led’ recovery will only stoke the fires of climate change, and cost the nation dearly in terms of jobs, industry, environment and global reputation,” Mr Smith said.

While the protestors marched on Parliament, the Prime Minister rejected the idea of introducing a carbon tax as a way of reaching net zero emissions.

“I’m not putting on a carbon tax, and I’m not putting up the GST,” Mr Morrison said to the National Press Gallery on Monday, 1 February. 

“They’re just tax increases. That’s all they are.”

Instead, the PM would look to invest in new skills and training for younger Australians, as well as focusing on improved technology to reduce carbon emissions. 

“If you don’t get there by technology, if that’s not used, then the only way to get there is by a tax,” he said.

Property investors unanimously agree that 2021 will kick off a three-year favourable investor environment with strong price growth.

After a year of high uncertainty, but one thankfully void of earlier doom-and-gloom scenarios, investors can kick up their heels and enjoy a three-year winning streak as property prices not only rebound but shoot up on the back of highly favourable economic trends.

This is the view shared by OpenCorp director Michael Beresford, who joined Nestegg's sister title on the Smart Property Investment show last week.

“It’s really appealing for property investors, and there seems to be a unanimous environment that 2021, at least kind of through to 2023, is going to be a really, really good time for investors and really strong price growth,” said Mr Beresford.

“The reason why we say that and the reason why that view is so well shared and agreed upon, the RBA have come out and said that cash rate at record lows of 0.10 per cent is going to remain for the next three years to get the economy re-stimulated.

“So, we know that with interest rates not moving anywhere, costs to hold are zero, properties will be paying for themselves, so you can be in the market without it impacting your lifestyle at all, provided you’ve got job security,” Mr Beresford explained.

He bases his confidence on previous years where clear upswings have followed serious downturns and the fundamentals that drive property markets – interest rates, population growth and supply, lending policies and government stimulus, infrastructure and spend.

“If we look at where everything is lining up on these fundamentals now, it’s really appealing for property investors,” Mr Beresford said.

Discussing population growth, he explained that despite Australia’s border policy, there has been more overseas migration this year than in previous years, with thousands of expat Aussies returning home.

“Supply to market has been dramatically reduced because developers are not as active, banks are not lending as much during downturn, so straight away the supply and demand dynamic is the way that we want it,” Mr Beresford said.

Moving on to lending policies and government stimulus, Mr Beresford opined that lending is where things get really exciting.  

“You can’t inject hundreds of billions of dollars into an economy, before we even think about quantitative easing and bond buying, without seeing an inflationary effect over the years to come,” he said addressing the government’s stimulus spend.

Next, and in regard to lending policies, Mr Beresford spoke about the pent-up demand.

“People are realising that the world is not going to end. They’re realising that prices are not going to crash, realising that interest rates are low and now is a good time to buy, and getting prepared to be buying into 2021.”

Professional property investor Scott O’Neill believes that prospective property investors have a lot to look forward to in 2021. 

In a recent chat with Smart Property Investment, Mr O’Neill, the founder and director of Rethink Investing, shared his thoughts on the year that was, the year that’s before us, and how best to secure a steady passive income portfolio whether you’re 20 or 70.  

While 2020 did not shape up quite as expected, the doom-and-gloom property forecasts have remained just words on paper, but moving into 2021, how do you expect the market to move amid possibly increased uncertainty and the predicted March economic cliff? 

For the commercial markets, 2020 was actually a very good year overall from an asset appreciation point of view. Of course, there were some exceptions to this such as CBD office space, and some retail assets didn’t perform well. This was due to COVID-19 closures and restrictions. But of other types of properties, this was actually one of the best years we have seen for increased buyer demand for quality tenant investments.

Why? It’s because, more than ever, people value high yield and security of tenant. Many commercial tenants offer more security than residential as well. For example, strong logistics companies, medical professional and even some office tenants such as accountants, solicitors and government tenants all did well in 2020. Also, anything related to “essential services” was the go-to for many investors looking to boost their passive incomes.

Trends to expect to see in 2021 – higher demand for quality assets. Particularly in industrial assets as many more investors see the benefits of the e-commerce boom, the need to logistics and storage. These trends have been around for a few years, but expect these trends to continue into 2021 at an even faster rate as consumer confidence hits seven-year highs.

Given everything 2020 has thrown at Aussies, I think many are looking to branch out and begin to build or expand their passive income portfolios. How do you suggest people approach this in a climate that, although not too turbulent, is certainly not ideal? 

The key is to understand the market and the investments you’re looking at from an expert’s point of view. If this is the first time you have considered commercial property, I highly recommend seeking professional help from a buyer’s agent who is an expert in commercial property (not residential). If you go into this complex field without doing enough homework, you can get burnt. But when you get it right, it will be more lucrative than residential property. Especially from a cash flow sense.

Your motto is, “No matter your age or your current position in life, it’s never too late to start building wealth through property investing”. Is this really the case?

Yes, we have clients as young as 20 years old all the way up to the late 70s. In fact, about one in 25 of our clients is over 70 years old. Proving it’s never too late to build yourself a passive income in property. Commercial property in particularly favours people who have less time to wait for capital growth.

Most people when they hit 30 start to yearn for an early retirement, and most dream of an enviable passive income stream, but is this actually achievable and how? 

Yes, it is. However, you need an income from your day job to fuel your investment portfolio. The more you earn, the faster you can progress into a “retirement grade” property portfolio. For some, it might take 10 years; others, it might be over 30 years.

If you stick to a plan of buying good quality higher-yielding assets that also benefit from capital growth, over the long run you will come up on top. This is why property investing is Australia’s number one source of early retirees.

Although he looked to capitalise on Sydney’s property boom a decade ago, luck would have it that Rizul Makkar would only begin to build his property portfolio four years later.

At the age of 18, Mr Makkar found himself chasing two paths, one a commerce degree and the other a full-time job in Sydney’s finance industry. One of the two would ultimately expose him to the property market fairly soon. 

Inspired by his parents’ advice, as well as the boom that was occurring in the Sydney market a decade ago, he decided to go after his first property right in the middle of one of Australia’s biggest property markets.

“My parents, growing up, were saying, ‘Get into property quickly. Property never goes down. You’re always going to make money’. So, that’s where the thought process came in early on. And if we scroll back to 2014, property in Sydney was really picking up. It was boom times.”

Mr Makkar planned to start his wealth-creation journey by buying an off-the-plan apartment in Blacktown, but was outbid every single time.

“With off-the-plan, the logic was always, ‘It’s only 5 per cent down now, so with the $25,000 I’d saved up, I just wait a couple of years until completion and then get the benefits of capital growth”. But that didn’t actually come in the end.”

However, it did not take long before he realised it was a blessing in disguise. 

“The boom times were crazy, so I missed out on a few properties and then thought to myself, ‘This boom time’s probably not the right time to be buying if I’m getting bid up on $500,000 apartments in Blacktown’.”

“So, I’m very happy to miss out on those first properties given what’s happened since then,” Mr Makkar shared.

It was only four years later that he would finally be purchasing his first property, way outside the Sydney property boom.

Mr Makkar spent these years honing his knowledge about property investment and crafting a strategy that would minimise risk and maximise returns.

Four years later

In 2018, Mr Makkar bought his first property – a three-bedroom, high-set house in Woodridge, about 20 kilometres south of Brisbane – after much research and due diligence.

“By this time, I’d been working full-time for four years, so I had saved up enough for the 20 per cent deposit and the 5 per cent stamp duty. I had the full deposit this time for the first property.

The property, which he bought for $260,000, was getting $340 a week in rent after a few cosmetic improvements. 

While Woodridge, as a suburb, hasn’t seen much significant growth over the years, Mr Makkar was able to get the property revalued up by another $50,000 within a year, which ultimately led to his second purchase.

Further, the Logan area was expanding, with infrastructure being built actively across multiple locations. 

Interstate investing

Instead of staying in Sydney, waiting to outbid everyone else, Mr Makkar decided to find more affordable entry points interstate, leading him to his first property in Brisbane.

According to him: “The idea of investing interstate came from the Smart Property Investment Show, encouraging me to say, ‘Hey, I don’t really need to just think about my own backyard. I don’t need to buy somewhere where I grew up. If I can find better value and potentially better returns elsewhere, I should definitely be open to that’.”

Mr Makkar believed that Brisbane was poised for growth after it hit the bottom following the end of the mining boom.

“I thought Brisbane is calming off, with 10 years of relatively low growth, but with the economy being quite diversified and the population growth not just coming from migrants, a lot of interstate movement.

“For the next few years, Brisbane is sort of ripe to grow in terms of population, and in terms of where the economic drivers are also sitting, Brisbane was hitting the bottom and things were looking quite positive post-mining boom that hit in 2012,” Mr Makkar said.

Education

Apart from listening to podcasts, Mr Makkar also educated himself through other accessible means, such as property blogs or webinars.

According to him, this was critical to minimising the risks of doing the first purchase, as well as jumping off to the next ones. Ultimately, it helped him filter out the noise and just take the lessons that would help him achieve his financial goals.

“Education helped me save a lot of the costly mistakes that I could have made by just learning from other people or what I think happens in property markets over time. So, I was researching pretty much anything I can get my hands on.”

His education also taught him that property booms could mean less than people make it out to be, especially as a criteria for a property purchase.

“Coming in early didn’t make a difference, or just waiting and holding on didn’t really make a difference, as well. It’s about making sure that the investment that I choose was the right one in terms of fundamentals.”

3 pillars of success

For Makkar, there were three important lessons that his first purchase taught him.

One of the fundamentals is land value, which ultimately urged him to stick with established houses in order to own land along with his properties.

“A lot of the property price growth that you get and the capital growth that you get comes from owning land, and so I sort of focused on buying houses, buying the established houses.” 

Secondly, he focused on the value-add opportunities in the properties that he buys.

“If I buy older, established houses, some of the brick basic houses that don’t really have any of the facilities, nothing really breaks down, and they’re there to last 100 years,” he explained.

Finally, Mr Makkar reviews historical data as a way to track trends, which could very well guide him in making decisions moving forward.

“I make sure I can time the state cycles. Every city, if you look back over the last 50 years, Adelaide housing, Sydney houses, they’ve all sort of grown roughly the same, but the cycles are completely different. So, while Sydney and Melbourne were having their boom, Perth, Adelaide, Brisbane haven’t really grown for a decade. 

“Outside Sydney, I thought, ‘I’m really getting good yields on this. I’m getting good cash flow, but then also there’s a lot more potential for capital growth because they’re just more affordable housing’.”

His advice to fellow investors: Keep educating yourself.

“You should always be educating yourself. Read macroeconomic news to work out where everything lies, to work out where some of the states are sitting at the moment relative to each other,” Mr Makkar concluded.
