Under the LMITO, workers with a taxable income of between $48,001 and $90,000 have received a tax offset of $1,080 each financial year since 2018-19.
Combined with the increase of $420 announced in the latest budget, the maximum LMITO benefit for 2021-22 will rise to $1,500 for individuals and $3,000 for couples.
In its budget papers released on Tuesday, the government said that the LMITO was targeted at low and middle income earners that are most susceptible to cost-of-living pressures.
“The government is responding in a temporary, targeted and responsible way to reduce cost of living pressures experienced by Australian households,” it said.
All LMITO recipients will receive the full $420 increase, including those earning less than $48,001 or between $90,001 and $126,000 who do not receive the full $1,080 tax offset.
“All other features of the current LMITO remain unchanged,” the government explained.
“Consistent with the current LMITO, taxpayers with incomes of $126,000 or more will not receive the additional $420.”
H&R Block director of tax communications Mark Chapman welcomed the expanded offset, but noted that the measure would only remain in place over the short term.
“Next year, the low and middle-income tax offset disappears completely - meaning that people earning up to $126,000 will see a tax rise of up to $1,080. It's hard to see how that will do anything to help cost of living pressures over the medium and long term,” he said.
“Worse, just as most Australians will see this tax rise, the wealthiest Australians will be anticipating a tax cut of up to $9,075 in 2024-25.”
The boost to the LMITO is expected to cost $4.1 billion according to budget estimates and a total of 4.8 million Aussies will receive the full $1,500 offset.
$250 cost-of-living payment
Furthermore, the government also unveiled a $250 cost-of-living payment that will be delivered to six million Australians next month.
“Pensioners, carers, veterans, job seekers, eligible self‑funded retirees and concession card holders will benefit,” Treasurer Josh Frydenberg said in his budget speech on Tuesday.
“Together, with existing indexation arrangements, this will see a single pensioner receive more than $500 in additional support over the next 6 months, just when they need it most.”
The one-off $250 cost of living payment will be tax exempt and will be paid automatically to all eligible pensioners, welfare recipients, veterans and eligible concession card holders in April.

The LMITO provides a tax offset of up to $1,080 for more than 10 million Australians and was previously extended twice in response to the effects of the COVID-19 pandemic.
However, the government has not confirmed whether it will be extended again in the next federal budget on 29 March.
“The low and middle income tax offset is not a permanent feature of the tax system. We’ve introduced it due to the particular economic circumstances of the time,” Treasurer Josh Frydenberg told ABC’s Michael Rowland.
“We haven’t made a decision about the low and middle income tax offset, but we have legislated significant structural reform as well as bringing forward stage two of the tax cuts.”
The Australia Institute expects that most taxpayers would be worse off with the removal of the LMITO alongside the introduction of stage three of the government’s tax cuts.
Stage three will create a single 30 per cent tax bracket for all Australians earning between $45,001 and $200,000 beginning in 2024.
“The net effect of the two tax changes will be that the two thirds of taxpayers on less than $90,000 a year are worse off, while the third of taxpayers on more than $90,000 a year are better off,” said Australia Institute senior economist Matt Grudnoff.
Mr Grudnoff also pointed out that the current timeline for the end of the LMITO does not align with the next stage of tax cuts.
“The LMITO ends in 2021-22 (with the refunds paid in 2022-23), while the stage three tax cuts do not start until July 2024,” he said.
“This means that almost 90 per cent of those who get the LMITO will face a tax increase in 2022-23. None of them will get any benefit from the stage three tax cuts until 2024-25.”
Treasury previously estimated that the extension of the LMITO for the 2021-22 financial year would reduce taxes by $7.8 billion, while the stage three tax cuts are expected to cost $15.7 billion during their first year.
When asked about the government’s plans for the LMITO, Mr Frydenberg compared it to the action taken by the government during the GFC.
“If you think back to Kevin Rudd and the global financial crisis with their $900 cheques or, indeed, during this recession when we did our $750 payments to pensioners, carers and veterans, that was based on the economic circumstances at the time,” he said.
“When they did not continue you didn’t say that veterans or carers lost income. They were a supplement based on the conditions at the time.”
Mr Frydenberg also highlighted that young women had been the greatest beneficiaries of the government’s tax cuts, with 5 million female workers paying an average of $3,130 less tax and women under 24 paying 20 per cent less, according to ATO and Treasury data.

In a recent interview with The Herald Sun, Prime Minister Scott Morrison played coy when asked whether the current federal government would consider extending the low and middle income tax offset (LMITO).
Introduced as part of the federal government’s tax cut agenda in 2018, the measure gives eligible Australians a tax benefit of up to $1,080 when they lodge their return on time. It was originally due to expire in 2020 but was extended in the wake of the COVID-19 pandemic.
The low and middle income tax offset is currently slated to expire on 20 June 2022.
While the Prime Minister refused to commit to extending the tax-saving measure, he didn’t rule it either.
Mr Morrison insisted that a decision about the offset would be made at “an appropriate time” but emphasised the current government’s track record for delivering tax cuts.
“If you really want people and business to get on and do things, you can’t keep more of what they earn; it has to go back the other way,” he said.
Speaking to nestegg, CPA Australia senior manager for tax policy Elinor Kasapidis reminded consumers that the measure was always intended to be temporary.
“It was due to be removed when the Phase 2 income tax cuts began but was continued to help low- and middle-income earners through COVID-19,” she said.
Ms Kasapidis said that repeated extensions of the LMITO have created the expectation that it will be maintained.
“This makes it harder for government to remove it, especially heading into an election year,” she said.
Acknowledging the ongoing economic uncertainty, Ms Kasapidis said that extending the LMITO for another year would be a reasonable step by the federal government.
“Continuing this relief would give many hard-hit Australian workers a bit more breathing room,” she said.
H&R Block director of tax communications Mark Chapman told nestegg that much of the media coverage around this has focused on Scott Morrison’s attempt to claim that he is delivering a tax cut by maintaining the low and middle income tax offset.
“He isn’t. Scott Morrison is simply proposing to defer a tax rise, one that he and his government have already legislated,” Mr Chapman said.
He noted that Mr Morrison and the federal government had not made the offset a permanent feature of the tax system. They’ve just talked about extending it.
“This raises the possibility that this is all spin, designed to see the government through the general election, at which point they will return to the already legislated abolition of the offset in 2023 or later,” he said.

ATO assistant commissioner Tim Loh admitted that the last few months have been turbulent for Australians, but said that the refund process isn’t as much of a time-sink as consumers might suspect.
“For people with simple tax affairs, lodging through our myTax service can be done and dusted in under 30 minutes. Most of your income and personal details will already be there; simply confirm it’s correct, add any additional income and claim your eligible deductions,” he said.
Mr Loh revealed that the ATO has already processed $20 billion in tax refunds to more than 7.2 million taxpayers in 2021.
“Four out of five people receive a refund with most refunds issued in less than two weeks. This process can’t be sped up, even if you call us,” he said.
That being said, Mr Loh noted that taxpayers still need to do their due diligence when it comes to the details.
He warned that mistakes like forgetting to include a bank account, leaving out income or making ineligible deductions can delay a refund.
“If you’re delaying lodgment due to an expected bill you can't pay right away, we encourage you to lodge this week. Even if you can’t pay on time, lodging your tax return shows us that you’re doing your best to meet your obligations,” Mr Loh said.
Speaking to nestegg, H&R Block director of tax communications Mark Chapman explained the consequences of failing to begin the process of lodging your tax return on time.
“The so-called 'failure to lodge' penalty is calculated at the rate of one penalty unit for each period of 28 days or part thereof that the return is overdue, up to a maximum of five penalty units,” he said.
“The value of a penalty unit is currently $222, so the maximum penalty which can be applied for an individual is $1,110.”
Mr Chapman doesn’t recommend it, but he added that you might still luck out even if you do miss that deadline.
“Where a penalty is applied, the ATO will sometimes remit it where it is fair and reasonable to do so, for example in the event of natural disaster or serious illness,” he said.
Those who don’t want to risk a fine and don’t have the time to meet the ATO’s 31 October deadline may still have options, but they’ll have to act fast.
Mr Loh recommended speaking to the ATO directly or a registered tax agent as soon as possible.
“You may also have a bit longer to get your return in; all you need to do is be registered with your agent before the end of this week,” he said.

" ["fulltext"]=> string(3361) "The Australian Taxation Office (ATO) has said it’s renewing efforts to improve the way it communicates with taxpayers regarding their rights.
Following an investigation by Inspector-General of Taxation and Taxation Ombudsman (IGTO) Karen Payne, the ATO said that many of the recommendations raised by the formal review were in the process of being addressed.
“Effective communication of taxpayer rights is an extremely important aspect of our work,” the ATO said.
Ms Payne’s report into whether and how the ATO communicates the rights of taxpayers found that training on taxpayer rights is not mandatory within the organisation, nor are staff required to be regularly refreshed on the topic through internal training.
These practices are made worse by low attendance patterns at ATO training around the Taxpayers’ Charter, which the report suggested might be as low as just 1 per cent over the last three years.
“Effective communication of taxpayer rights to complain, review and appeal ATO decisions and actions is vitally important, not the least because it provides assurance to taxpayers that they have been treated fairly,” Ms Payne said.
The final report made a number of recommendations for the ATO to consider, including the updating of the Taxpayers’ Charter to include an explicit and express right to be informed of their right to review, complain and appeal decisions made by the organisation.
Tax Institute senior advocate Robyn Jacobson called the report a win for taxpayers looking to better understand their rights.
“A taxpayer’s right to be informed of their objection and complaint rights is fundamental to ensuring the tax system is fair and that all taxpayers are treated equally,” she said.
Ms Jacobson said that many taxpayers are unaware of their rights when it comes to dealing with the ATO, and that the difficulty of finding relevant information leads to “countless” instances of taxpayers being left ignorant of their options.
With the ATO’s response promising to implement all six recommendations made by the report, Ms Jacobson said that “the ATO’s response in acknowledging and adopting the recommendations in whole or principle is both welcome and important”.
However, she added that merely informing taxpayers of their rights may not go far enough.
“Taxpayers need to understand the instances where lodging an objection is the most suitable pathway compared to where lodging a complaint is more appropriate,” she said.
“Without this education and accessible information, taxpayers will continue to be left in the dark and may unwittingly choose an unsuitable pathway to their detriment.”

Speaking to nestegg, H&R Block director of tax communications Mark Chapman explained that Australians who earn more than the current tax-free threshold of $18,200 over the course of the year are required to lodge their tax return by the end of October.
“In some cases, you may be required to lodge even if you earn less than that amount; for example, if you worked and had tax deducted from your pay,” he added.
If you don’t, Mr Chapman said that you could be looking at a stiff fine.
Failing to lodge your taxes by the deadline can incur financial penalties of as much as $1,110.
“The so-called ‘failure to lodge’ penalty is calculated at the rate of one penalty unit for each period of 28 days or part thereof that the return is overdue, up to a maximum of five penalty units,” Mr Chapman explained.
“The value of a penalty unit is currently $222, so the maximum penalty which can be applied for an individual is $1,110.”
Even if you do miss that deadline and risk penalties, Mr Chapman said that you might still luck out.
While the penalty for late lodgers is normally applied automatically, he noted that it is not normally applied to returns that either have a nil result or generate a refund.
“In addition, where a penalty is applied, the ATO will sometimes remit it where it is fair and reasonable to do so; for example, in the event of natural disaster or serious illness,” he said.
Of course, there’s one other way that cheeky late lodgers can avoid being fined by the ATO.
Despite the looming deadline, Mr Chapman revealed that “you can actually lodge much later than that without being penalised”.
“You simply need to be registered as a tax agent client by 31 October 2021 and you can lodge your tax return through that agent as late as 15 May 2022,” he said.
CPA senior manager for tax policy Elinor Kasapidis told nestegg that engaging an accountant could give you until well into 2022 to lodge your 2020–21 tax return.
“But you must make sure you are registered as a client with your tax agent to be eligible to delay lodging your tax return,” she said.
For those worried about missing the deadline, Ms Kasapidis recommended keeping calm and seeking advice from an expert.
“Don’t rush through your tax return, as this may lead to mistakes,” she said.
“Remember, you can cut your own hair, but you’ll get a better result if you see a professional.
“It’s the same with completing your tax return. If you see a tax agent, you can be confident you’re paying the right amount of tax and getting the maximum refund you’re entitled to.”
