Time is running out for those who are still putting off taking the time to do their taxes.

If you haven’t lodged your tax return yet, the Australian Taxation Office (ATO) is giving you one last reminder.

ATO assistant commissioner Tim Loh admitted that the last few months have been turbulent for Australians, but said that the refund process isn’t as much of a time-sink as consumers might suspect.

“For people with simple tax affairs, lodging through our myTax service can be done and dusted in under 30 minutes. Most of your income and personal details will already be there; simply confirm it’s correct, add any additional income and claim your eligible deductions,” he said.

Mr Loh revealed that the ATO has already processed $20 billion in tax refunds to more than 7.2 million taxpayers in 2021.

“Four out of five people receive a refund with most refunds issued in less than two weeks. This process can’t be sped up, even if you call us,” he said.

That being said, Mr Loh noted that taxpayers still need to do their due diligence when it comes to the details.

He warned that mistakes like forgetting to include a bank account, leaving out income or making ineligible deductions can delay a refund.

“If you’re delaying lodgment due to an expected bill you can't pay right away, we encourage you to lodge this week. Even if you can’t pay on time, lodging your tax return shows us that you’re doing your best to meet your obligations,” Mr Loh said. 

Speaking to nestegg, H&R Block director of tax communications Mark Chapman explained the consequences of failing to begin the process of lodging your tax return on time. 

“The so-called 'failure to lodge' penalty is calculated at the rate of one penalty unit for each period of 28 days or part thereof that the return is overdue, up to a maximum of five penalty units,” he said.

“The value of a penalty unit is currently $222, so the maximum penalty which can be applied for an individual is $1,110.”

Mr Chapman doesn’t recommend it, but he added that you might still luck out even if you do miss that deadline.

“Where a penalty is applied, the ATO will sometimes remit it where it is fair and reasonable to do so, for example in the event of natural disaster or serious illness,” he said.

Those who don’t want to risk a fine and don’t have the time to meet the ATO’s 31 October deadline may still have options, but they’ll have to act fast.

Mr Loh recommended speaking to the ATO directly or a registered tax agent as soon as possible.

“You may also have a bit longer to get your return in; all you need to do is be registered with your agent before the end of this week,” he said.

Australia’s tax collector has been told to get better at dealing with complaints, appeals and the rights of taxpayers.

The Australian Taxation Office (ATO) has said it’s renewing efforts to improve the way it communicates with taxpayers regarding their rights.

Following an investigation by Inspector-General of Taxation and Taxation Ombudsman (IGTO) Karen Payne, the ATO said that many of the recommendations raised by the formal review were in the process of being addressed.

“Effective communication of taxpayer rights is an extremely important aspect of our work,” the ATO said.

Ms Payne’s report into whether and how the ATO communicates the rights of taxpayers found that training on taxpayer rights is not mandatory within the organisation, nor are staff required to be regularly refreshed on the topic through internal training.

These practices are made worse by low attendance patterns at ATO training around the Taxpayers’ Charter, which the report suggested might be as low as just 1 per cent over the last three years.

“Effective communication of taxpayer rights to complain, review and appeal ATO decisions and actions is vitally important, not the least because it provides assurance to taxpayers that they have been treated fairly,” Ms Payne said.

The final report made a number of recommendations for the ATO to consider, including the updating of the Taxpayers’ Charter to include an explicit and express right to be informed of their right to review, complain and appeal decisions made by the organisation.

Tax Institute senior advocate Robyn Jacobson called the report a win for taxpayers looking to better understand their rights.

“A taxpayer’s right to be informed of their objection and complaint rights is fundamental to ensuring the tax system is fair and that all taxpayers are treated equally,” she said.

Ms Jacobson said that many taxpayers are unaware of their rights when it comes to dealing with the ATO, and that the difficulty of finding relevant information leads to “countless” instances of taxpayers being left ignorant of their options.

With the ATO’s response promising to implement all six recommendations made by the report, Ms Jacobson said that “the ATO’s response in acknowledging and adopting the recommendations in whole or principle is both welcome and important”.

However, she added that merely informing taxpayers of their rights may not go far enough.

“Taxpayers need to understand the instances where lodging an objection is the most suitable pathway compared to where lodging a complaint is more appropriate,” she said.

“Without this education and accessible information, taxpayers will continue to be left in the dark and may unwittingly choose an unsuitable pathway to their detriment.”

Most taxpayers lodge their return ahead of the 31 October deadline for good reason.

Speaking to nestegg, H&R Block director of tax communications Mark Chapman explained that Australians who earn more than the current tax-free threshold of $18,200 over the course of the year are required to lodge their tax return by the end of October.

“In some cases, you may be required to lodge even if you earn less than that amount; for example, if you worked and had tax deducted from your pay,” he added.

If you don’t, Mr Chapman said that you could be looking at a stiff fine.

Failing to lodge your taxes by the deadline can incur financial penalties of as much as $1,110.

“The so-called ‘failure to lodge’ penalty is calculated at the rate of one penalty unit for each period of 28 days or part thereof that the return is overdue, up to a maximum of five penalty units,” Mr Chapman explained.

“The value of a penalty unit is currently $222, so the maximum penalty which can be applied for an individual is $1,110.”

Even if you do miss that deadline and risk penalties, Mr Chapman said that you might still luck out.

While the penalty for late lodgers is normally applied automatically, he noted that it is not normally applied to returns that either have a nil result or generate a refund.

“In addition, where a penalty is applied, the ATO will sometimes remit it where it is fair and reasonable to do so; for example, in the event of natural disaster or serious illness,” he said.

Of course, there’s one other way that cheeky late lodgers can avoid being fined by the ATO.

Despite the looming deadline, Mr Chapman revealed that “you can actually lodge much later than that without being penalised”.

“You simply need to be registered as a tax agent client by 31 October 2021 and you can lodge your tax return through that agent as late as 15 May 2022,” he said.

CPA senior manager for tax policy Elinor Kasapidis told nestegg that engaging an accountant could give you until well into 2022 to lodge your 2020–21 tax return.

“But you must make sure you are registered as a client with your tax agent to be eligible to delay lodging your tax return,” she said.

For those worried about missing the deadline, Ms Kasapidis recommended keeping calm and seeking advice from an expert.

“Don’t rush through your tax return, as this may lead to mistakes,” she said.

“Remember, you can cut your own hair, but you’ll get a better result if you see a professional.

“It’s the same with completing your tax return. If you see a tax agent, you can be confident you’re paying the right amount of tax and getting the maximum refund you’re entitled to.”

The single largest contributor to the failure of small businesses is financial mismanagement, and Australia’s growing legion of side hustlers could be at risk if they don’t take care.

Speaking to nestegg, H&R Block director of tax communications Mark Chapman explained that this financial mismanagement can take many forms, from failing to keep track of cash flow to forgetting to register for GST.

“While a lack of cash flow is indeed the number one business killer, there are simple ways to get on top of it,” he said.

For those looking for a place to start, he recommended engaging a tax professional to put together a business activity statement (BAS).

“Your BAS is a vital part of meeting your compliance requirements with the ATO and is a legal mandate,” Mr Chapman said.

“The exercise of completing a BAS, alongside a professional, forces SMBs to focus on the financial side of the business — to grapple with sales, purchases and cash flow.”

In terms of specific advice, Mr Chapman also warned small business owners not to bury their head in the sand when it comes to record-keeping.

“Keep your books and records up to date and the BAS process will be straightforward and you’ll have the necessary oversight of the financial side of your business,” he said.

Mr Chapman added that neglecting your bookkeeping duties can have an adversarial effect for SMBs that extends far beyond meeting your tax obligations.

“Not only will you struggle to complete your BAS, you also won’t understand your business’s profitability and its cash flow position,” he said.

Finally, Mr Chapman reminded SMB owners and side hustlers that lodging their BAS is a legal mandate.

He warned that failing to lodge your BAS by the 28 October deadline can incur financial penalties that range from as little as $222 and as much as $1,110.

Now more than ever, Mr Chapman said that small businesses should make sure they can have a trusted partner to rely on when it comes to their various legal and tax obligations.

Starting a side hustle can open a path towards financial freedom, but that opportunity comes with the risk of falling afoul of the Australian Taxation Office.

Director of tax communications at H&R Block Mark Chapman said that starting a side hustle comes with tax obligations that have to be met.

“Ignore them, and you can quickly run into trouble with the taxman,” he said.

The first tip that Mr Chapman offered when it comes to side hustles is to remember that every extra dollar your business earns will count against your annual taxable income.

Even if you get paid in cash, you’ll need to declare that additional income. Mr Chapman warned that not doing so comes with significant risks, so it’s much better to err on the side of caution.

“The ATO traps many businesses that — deliberately or otherwise — don’t record cash sales,” Mr  Chapman said.

If the annual turnover of your business is greater than $75,000, you’ll also have to register your small business for GST and apply that tax to transactions. Having to do adopt this extra tax obligation can sometimes work in your favour.

“You can offset the GST you pay on your purchases and expenses against the GST you owe; only the net figure is paid to the taxman,” Mr Chapman explained.

Keeping track of just how much extra income you need to declare can be messy.

To help alleviate this, Mr Chapman recommended investing in your business via professional bookkeeping software.

“Sure, it’s an extra cost, but it’s one less stressful task to worry about,” he said.

“There are lots of accounting software packages out there that will help you keep on top of your figures, but if you’re not a numbers person, consider getting a professional bookkeeper to do the job for you.”

Having the right records in place is also an important step when it comes to deductions.

Handling this aspect of the tax system correctly can usually be time-consuming, but it’s usually worth the trouble. The total extra income of your side hustle is going to be dependent not just on the amount earned, but also the amount of deductions made.

For that reason, Mr Chapman advocated for both consistency and comprehensiveness.

“Make sure you claim all your business expenses, whether that’s the cost of buying stock, heating your office, marketing your brand or travelling to meet customers — or any of the numerous other expenses you might incur,” he said.

Mr Chapman said that one of the most common pitfalls for new business owners is failing to set money aside to pay their taxes.

“Particularly if you’re coming out of a paid job, you’re probably used to getting your taxes deducted straight from your pay packet by your employer,” he said.

“But now you’re in business on your own account, nobody is going to be deducting anything, so you need to proactively manage your cash flow to set money aside for future tax bills.”

Mr Chapman said that for small businesses, cash flow is king.

“Even if you seem to be trading profitably, if your customers aren’t actually paying your invoices, you’ll struggle to pay your debts and one organisation you definitely don’t want to end up in debt to is the ATO,” he said.

For those who need an extra reason to submit their tax return before the October deadline, director of tax communications at H&R Block Mark Chapman has four words of encouragement: Stage 2 tax cuts.

Mr Chapman said that these tax cuts, introduced in October by last year’s federal budget, mean that those who get their taxes in on time should expect a “bumper” return.

“That’s because of the low and middle income tax offset and also the change in tax thresholds from 1 July 2020,” he said.

Mr Chapman said that an individual on an income of around $80,000 should expect to come away with a tax balance that’s about $1,500 better than it would be otherwise, regardless of whether it’s a return or a reduction in the amount of tax payable.

Of that $1,500, Mr Chapman explained that around $1,080 was due to the new low and middle income tax offset. The way this offset works is relatively simple, but also convoluted.

If your income is less than $126,000, you’ll get at least some or all of the offset. For those who earn less than $37,000, the offset caps out at $255. If you earn between $37,000 and $48,000, the offset will increase up to a maximum of $1,080.

Those with annual incomes of between $48,000 and $90,000 will receive the full offset. However, those who earn more than $90,000 will see the offset gradually fade out.

If you earn more than $126,000 a year, you won’t come away with any offset on your tax payable for the year.

Importantly, “you MUST lodge your tax return in order to get the offset”, Mr Chapman said.

This offset isn’t the only reason to raise your expectations when it comes to your tax return this year.

Mr Chapman noted that the other half of the Stage 2 tax cuts “arises from the change in tax thresholds”.

Originally due to come into effect in the 2023–2024 financial year, these changes see the 19 per cent tax threshold shift from $37,000 to $45,000. 

Meanwhile, the previous $37,001–$90,000 tax bracket is set to be replaced with a new $45,001–$120,000 one.

Australians who fall into this category when it comes to annual income will be subject to a 32.5 per cent tax rate.

Finally, those who earn more than $120,001 will face a higher 37 per cent tax bracket.

As a result of these shifts in Australia’s various tax brackets, those who earned close to the upper or lower limits of a given bracket may now have changed brackets.

Since these new tax rates only apply to income earned after the 1st of December 2020 onwards, Mr Chapman estimated that an Australian on a salary of around $80,000 should expect around $400 in tax back.

While taxes are a subject that gets people talking about how much they’re, the combined impact of these two measures seems primed to ensure that 2021 is a year when the opposite is the case.
