One million Aussies are now invested in crypto, but many have not thought about how these investments will affect them at tax time.

Recent research from Roy Morgan indicated that 5 per cent of the population now owns at least one cryptocurrency with an average investment of just over $20,000 each.

With tax time fast approaching, H&R Block director of tax communications Mark Chapman said that Aussie crypto investors should be thinking about the tax implications of their investments.

“It’s surprising how many people go into crypto investment and simply don’t consider the tax implications,” he said.

One misconception highlighted by Mr Chapman is that taxpayers can buy up to $10,000 of cryptocurrency and avoid paying capital gains tax (CGT) by taking advantage of the personal use exemption.

"This exemption only applies where the cost of the cryptocurrency does not exceed $10,000 and you can demonstrate that the cryptocurrency was to fund genuine personal consumption, such as paying for a holiday, a car, your wedding, etc,” explained Mr Chapman.

“Mistakenly relying on this exemption is one of the biggest reasons people fall foul of the ATO; expect to be asked to provide proof that you either did – or intended to – use your cryptocurrency to fund personal spending on goods and services.”

If the cost of a crypto-asset exceeds $10,000, the personal use exemption will not be available to the taxpayer and CGT will apply regardless of whether the asset was for personal use.

Mr Chapman said that the disposal of crypto would generally be subject to CGT, which is calculated based on the difference between the amount an individual paid for the asset and the amount they disposed it for.

Disposal can include selling, exchanging, gifting or trading crypto as well as using crypto to pay for goods and services.

“Any profit is subject to CGT, which can potentially be discounted by 50 per cent if you hold your crypto-asset for more than 12 months. If you have undertaken many trades during the year, this could make calculating gains and losses difficult,” noted Mr Chapman.

However, if an individual has acquired crypto to trade it, they could be considered to be running a business of crypto trading. If this is the case, Mr Chapman indicated that the individual would instead need to pay income tax on the business profits.

“If you buy and sell cryptocurrency on a regular basis with a view to making a profit, then the profits on disposal of the cryptocurrency will not be subject to CGT but will be assessable income since you will be regarded as a trader rather than an investor,” he said.

“It can be a fine line between being an investor and a trader – broadly speaking if you are turning over your cryptocurrency every few days chasing profits, you have many transactions and you are running a business-like structure you will be a trader. If you are holding the cryptocurrency with a view to long term gain, you are likely to be an investor.”

Due to the complexity of crypto investing and trading, Mr Chapman suggested that individuals should use a tax agent who understands the appropriate tax implications.

“H&R Block, for example, uses CryptoTaxCalculator, a software program that is able to consolidate all digital transactions across multiple wallets, to calculate capital gains and losses of the previous year, and what your tax on each trade may be,” he added.

Mr Chapman also recently shared some actions that Aussies can take now to help maximise their tax returns.

Australia’s Centrelink recipients who’ve been doing it tough are in for a potentially easier time if the federal government pursues ambitious reforms that could provide sturdier safety nets.

It’s the pre-election push from social policy advocates including one of Australia’s largest charities, St Vincent de Paul Society (SVDP), which has called on the federal government to adopt a transformative overhaul to welfare and taxation policy - modelled on a report published by the Australian National University (ANU) Centre for Social Research and Methods.

The report from ANU, entitled A Fairer Tax and Welfare System, advocates for a more just taxation system that would significantly reduce the risk of Jobseekers and pensioners from having to face a maze of taxation complexities that could potentially leave them further out-of-pocket.

It’s a huge problem for recipients who have continually felt the ire of punitive federal policies implemented through Services Australia and the Australian Taxation Office (ATO) using controversial schemes including ‘RoboDebt’ — a scheme where people who owed money to welfare agencies received blunt debt notices or had their debts automatically snatched from their tax returns.

The Coalition’s unprecedented snooping powers on Centrelink’s highly vulnerable customer base led to a high-profile class action in 2019, where the Commonwealth was ordered to cash out a settlement of more than $1.7 billion to about 430,000 people.

Having a gutful of the federal government’s aggressive pursuit on welfare recipients’ nickels and dimes, and hoping to prevent such punitive measures from being implemented again, SVDP has formally endorsed ANU’s report examining a set of three options that claims to help families and individuals at risk of deep poverty and financial stress.

According to the report, all three options can increase Commonwealth Rent Assistance by 50 per cent.

The report’s options present ‘low’, ‘medium' and ‘high’ varieties that would significantly improve the income prospects for welfare recipients.

The ‘low’ option boosts JobSeeker benefits by $150 per fortnight; the ‘medium’ option increases JobSeeker benefits, Disability Support and Carer Pensions by $200 per fortnight, and increases the Parenting Payment (Single) to a new JobSeeker rate for single parents ($886 per fortnight).

While the ‘high’ option echoes the massive welfare hikes that the Morrison government offered to existing and new recipients at the advent of the COVID-19 pandemic in early 2020 (and have since been rolled back), increasing JobSeeker benefits by $436 per fortnight, Disability Support and Carer Pensions by $200 per fortnight, Parenting Payment to the new JobSeeker rate, and Family Tax Benefit Part A by 20 per cent ($40 per fortnight for children under 13 years).

Naturally, SVDP strongly supports the ‘high’ option as its national president, Claire Victory said it would help lift one million people out of poverty and “restore their dignity”, and potentially help them move towards re-entering the workforce.

”Far too many Australians are struggling to put food on the table, pay the rent in often unsuitable housing, and ensure that their children get the start in life they deserve. Increasing social security improves health, wellbeing and social outcomes, and also benefits the economy – so it’s an all-round win-win,” Ms Victory said.

In the days following the Annual Budget 2022-23 announcement handed down by Treasurer Josh Frydenberg on 29 March, Ms Victory was eager to highlight that the government’s $4.00 a day increase to JobSeeker will make “no impact” on poverty, lamenting that the Budget “contained no long-term solution to the nation’s chronic poverty”.

According to the report’s key author, associate professor Ben Phillips, the ANU modelling highlights strategies to reduce poverty without running up national debt or requiring anyone to make significant sacrifices.

“Our modelling shows you could make a massive difference to the lives of the bottom 20 per cent of income earners while only making a minimal change to the earnings of the top 20 per cent,’ Associate Professor Phillips said.

“Under our proposed changes, the highest income earners would still retire with very healthy superannuation savings and continue to benefit strongly from their other investments. But up to a million people would get their heads above the poverty line.”

SVDP said it will present its suite of election policy papers to sitting MPs and the half Senate, as well as other candidates once they are announced.

If you’re a first-time home buyer with an outstanding HECS debt, you might be setting yourself up for a tax surprise.

CPA Australia senior manager of tax policy Elinor Kasapidis told nestegg that First Home Super Saver Scheme (FHSSS) amounts are taxed at the time they’re withdrawn to pay for a property purchase.

“This means that the deposited amount plus earnings will be added to the first home buyer’s taxable income for that financial year,” she said.

While the current maximum FHSSS contribution is $30,000, the government has flagged an increase to $50,000 in the future.

Ms Kasapidis said that this amount would be enough to push many taxpayers into a higher marginal tax rate, which could, in turn, increase their HELP repayments.

“This could lead to an unpleasant surprise when the tax bill comes,” she said.

Ultimately, Ms Kasapidis said that the FHSSS shouldn’t be treated any differently to any other financial agreement.

She recommended that consumers always read and make sure they understand the fine print of government programs to avoid unexpected liabilities.

“A tax agent can help you understand the tax consequences of participating in the FHSSS, including potential tax liabilities when you withdraw your FHSSS amounts,” she said.

Research recently released by Homeloanexperts.com.au earlier this year asserted that a majority of millennials believe that the housing market needs more regulation in order to slow housing price growth and entice more first home buyers into the market.

A further 40 per cent of those surveyed said that these new measures should look to target first home buyers directly, akin to the government’s First Home Super Saver Scheme.

In the absence of affordability, Homeloanexperts.com.au chief executive Alan Hemmings said millennials are looking to find new ways into the market.

“Whether this involves them delaying their purchase, turning to family members to act as guarantor or even considering other options like rentvesting, millennials are being forced to consider other methods in their property journey,” he said.

Social services sector advocates have warned that further tax cuts may make solving Australia’s biggest challenges much harder.

The Australian Council of Social Services (ACOSS) and its member organisations have called on both of Australia’s major parties to rethink the long-term consequences of recent tax cuts.

ACOSS CEO Dr Cassandra Goldie said that both recent challenges like the COVID-19 pandemic and the Black Summer bushfires and looming ones like climate change and Australia’s aging population called for a government armed with the revenue needed to act and produce solutions to big problems.

“We call on our political leaders to guarantee that if they win government, they will raise the resources needed to meet these challenges and properly fund essential services and income supports rather than cutting them back,” she said.

Pointing to the disparity between Australia’s status as one of the wealthiest countries in the world when measured by median household wealth and the fact that it has one of the lowest levels of social expenditure in the OECD, Dr Goldie slammed the commitments of both the Liberal and Labor parties to “unaffordable” income tax cuts.

“Responsible government is not small or passive government. We cannot afford a contest over who can offer bigger tax cuts,” she said.

According to the 2021 budget papers, federal government expenditure per person will fall by an average of 0.7 per cent each year from 2022 as new tax cuts kick in.

In a statement, ACOSS also advocated for the rescinding of new tax cuts for those on higher incomes, the shielding of those on the lowest from the effects of spending cuts and a fully-fledged review of the tax system itself.

The organisation argued that this overhaul would help strengthen revenues, improve fairness within the system and eliminate socially harmful tax concessions like fossil fuel subsidies.

Dr Goldie cited the effectiveness of costly-but-effective policy measures like the COVID supplement and argued that more such measures might be needed in the future.

“Poverty was halved when the COVID supplement was available, over 700,000 jobs were saved, child care was affordable and people sleeping on the streets were housed,” she said.

“We must now confront persistent poverty and inequality, an ageing population, the spread of mental illness and domestic violence, and the catastrophic threat of climate change. The next government cannot do these things with the resources available to it.”

Reforms to Australia’s telecommunication intercept laws could see Australia's tax man granted the ability to listen in on the conversations of taxpayers.

Speaking on the release of a public discussion paper outlining the government’s plans to update domestic surveillance laws, federal Minister for Home Affairs Karen Andrews was adamant that the measures would strike the right balance.

“The government will balance the need for agencies to have the powers they require to protect Australians, while ensuring these powers are subject to robust controls, safeguards and oversight,” she said.

A key reform proposed by the discussion paper includes the broadening out of electronic surveillance mechanisms to new government bodies with a “clear and compelling” case for accessing them.

The list of potential beneficiaries of this includes both the Australian Transaction Reports and Analysis Centre (AUSTRAC) and the Australian Taxation Office (ATO).

For the former, the government argued that the power to intercept telecommunications data could play a valuable role in AUSTRAC’s mission to deter money laundering and financing of terrorism.

In contrast, the argument for the ATO having access to the data is more defensively oriented.

“With respect to the ATO, access to telecommunications data would support or, in some cases, potentially replace expensive, resource-intensive and intrusive physical surveillance operations,” the discussion paper said.

The stats suggest that the tax tribulations of the pandemic drove more businesses and consumers to rely on Australia’s Tax Practitioners Board (TPB).

According to the latest report by the regulator, the challenges of the last 12 months only brought tax practitioners and taxpayers closer together.

“As Australia and the world continued to grapple with the ongoing implications of the coronavirus pandemic, we also continued to ensure that tax practitioners were enabled to provide quality and ethical taxation services while maintaining the high levels of trust placed in them by their clients, the Australian public,” TPB chair Ian Klug said.

Over the past 12 months, the TPB said that it reviewed 170 cases of potential misconduct. Seventy-five of these investigations resulted in the termination of a practitioner’s registration.

He noted that annual TPB register searches exceeded 2 million for the first time in the 2020–2021 financial year.

In addition to these queries, TPB staff answered around 20,000 emails and letters and approximately 29,000 telephone enquiries.

Mr Klug suggested the growth in the usage of the TPB as a resource mirrors the increase in consumer and business awareness of the organisation.

He noted that 80 per cent of business owners are not aware of the tax regulator, up on 67.7 per cent in December 2020.

Consumer awareness of the TPB has also risen in recent months from 38.5 per cent in December 2020 up to 57.7 per cent in July 2021.

Looking forward, Mr Klug called the federal government’s recent response to the independent review into the effectiveness of the TPB and the Tax Agent Services Act 2009 a “positive step forward for the future”.

“In line with the review recommendations, we are working to finalise our memorandum of understanding with the ATO and formalise our data‑sharing arrangements with various agencies and stakeholders,” he said.

Mr Klug also indicated that the TPB would be looking to focus more on unregistered preparers in the coming year.

“We continue to invest in and improve on our data analytics capabilities to drive our compliance work, investigating those practitioners who choose to do the wrong thing, while supporting the majority that continue to uphold the high expectations of the profession and the integrity of our tax system,” he said.
