Refunds from the government’s illegal robodebt scheme are now being rolled out to affected customers – so what do you need to do to receive your refund?

nestegg has previously explained that there will be two separate processes for refunds, depending on whether or not you currently receive payments from the government. 

If you currently receive payments from Services Australia, you should receive your refund automatically – there is nothing further you need to do.

If you are a past customer but you are eligible for an income compliance refund, it’s important that you update your details online through myGov.

“If you don’t, we can’t process your refund,” Services Australia advised.

To update your details:  

1. Sign into myGov and go to your Centrelink online account – if you do not have one of these, you can register for one.
2. Select the “refund pending” task.
3. Click “start task” and follow the prompts to complete and submit your updated details.

Once your details are updated, you can expect to receive your refund within five business days, according to Services Australia.

It’s expected that the majority of robodebt refunds will be provided to victims by the end of November 2020.

Refunds will include repayments of any recovery fees and interest charges that were applied to the debt, while larger refunds will be paid out in instalments.

With the government’s recent concession that it would be refunding $721 million from robodebt notices, many Australians are wondering when they can expect the money to be returned to their hip pocket.

According to a statement from Services Australia, it’s “soon”.

The government department has revealed that it will be writing to anyone eligible for a refund from mid-July, where those people made repayments on income compliance debts where the debt was raised using averaging of Australian Taxation Office income information.

In cases where no money has been paid towards an eligible debt, Services Australia has indicated that debt would be reduced to zero.

A small number of refunds will be rolled out from early July to test out the refund system.

Robodebt Refunds will then be made from late-July, and Services Australia outlined that it expects most refunds to be paid by the end of November 2020.

Refunds will include repayments of any recovery fees and interest charges that were applied to the debt, while larger refunds will be paid out in installments, according to Services Australia.

What is the process for refunds?

Services Australia said there will be two separate processes for refunds, depending on whether or not you currently receive payments from the government.

If you do currently receive payments, you do not need to get your refund.

If you do not currently receive a Services Australia payment, you’ll need to update your details from late July using your Centrelink online account through myGov.

The government first indicated that it would be refunding all repayments made on debts that were raised wholly or partially using income leveraging of ATO data in late May. 

This was followed by Prime Minister Scott Morrison offering his “deep regret” to individuals who were affected by the scheme. 

In June, he said, “I would deeply regret any hardship that has been caused to people in the conduct of that activity.”

“The business of raising and recovering debts on behalf of taxpayers is a difficult job,” he commented.

According to Services Australia, Centrelink debt won’t be referred to external collection agencies for the next six months.

Tax refunds also won’t be chased for the purpose of settling government debts.

The government agency said it won’t be asking Australians to repay any monies owed “unless the debt relates to fraud or serious non-compliance”.

“This means that during these difficult times, you can focus on your personal situation.”

The pause will initially last for a six-month period – until October 2020.

For those individuals who already have a payment arrangement in place and can continue to pay off such debts, this pause will not apply.

For anyone who does need to reduce or stop their repayments for a period, they are encouraged to contact Centrelink’s debt line.

Almost one in four Australians in a relationship doesn’t trust their partner when it comes to money, a survey has revealed.

A further 27 per cent of coupled-up individuals consider trusting their partner with money management “depend[ing] on the circumstances”, according to the recently released St.George Family Finances survey.

With economic uncertainties now rife, it would make sense that couples need to be having honest conversations around their financial situation, even when it’s possibly uncomfortable.

The survey highlighted that almost one in 10 people in committed relationships is not open and honest with their partner about debt and their financial situation.

It also found that more than three in 10 coupled-up Australians believe managing personal debt can add an extra level of stress to their relationship.

For Ross Miller, the general manager at St.George Bank, “trust and openness are so important in committed relationships, particularly when it comes to money”.

“Across the board, couples aren’t talking about money nearly enough,” he continued.

“This is a problem because we know that those in debt could see their financial situation snowball, causing potential problems for them and their relationship in the future.

“Being open is particularly important for couples because, ultimately, at some point in their lives, their true financial situation is likely to be revealed.”

He concluded: “Whether it’s problems with credit history when they apply for a home loan, combining household income for a family tax return, or in the unfortunate incidence of getting a divorce, a person’s financial situation can rarely stay secret in a relationship forever.”

Bankruptcy laws are set to change in response to the increasing number of Australians set to suffer financially as a result of the coronavirus fallout.

Among the proposed economic initiatives put forward by Prime Minister Scott Morrison and the Treasury on Sunday, 22 March, were a number of changes to bankruptcy law.

According to the Australian Financial Security Authority (AFSA), the debt threshold for creditors to apply for a bankruptcy notice against a debtor will increase to $20,000.

In addition, the time frame for a debtor to respond to a bankruptcy notice before a creditor can commence bankruptcy proceedings will be increased to up to six months.

The temporary protection period procedure available for debtors is also likely to change to prevent recovery action by unsecured creditors for a six-month period.

AFSA has outlined that the changes are expected to come into effect shortly.

A Victorian man has been convicted of disposing property and making a false declaration to authorities about his financial circumstances prior to filing for bankruptcy.

In a statement outlining the conviction that doubled as a warning to all Australians, the Australian Financial Security Authority (AFSA) has highlighted that “disposing of property within 12 months of going bankrupt and making a false declaration are offences under Commonwealth bankruptcy law”.

James Brendan Nash was sentenced to a 12-month community corrections order that includes 120 hours of community service after he pleaded guilty to disposing of more than 30,000 shares held in a private company six months before he declared bankruptcy in April 2015.

He also disposed of five ordinary shares from a separate company “that would have potentially yielded a significant dividend” in January 2015.

AFSA said Mr Nash failed to declare that he had sold, transferred or given away shares in a private company in his statement of affairs.

He also did not declare his previous holding of a company directorship position.

The “serious nature of the charges warranted action”, according to the magistrate presiding over the matter, despite Mr Nash’s low risk of reoffending and guilty pleas.

AFSA’s deputy chief executive, Gavin McCosker, has reiterated the serious nature of any and all efforts to defraud Australia’s personal insolvency system, considering the authority as “a firm and fair regulator”.

“We take enforcement action against those who have broken the law to maintain the public’s confidence in the personal insolvency system,” he commented.

Taking alleged breaches of bankruptcy law seriously, the deputy chief executive noted that AFSA will investigate any issues and work with the Commonwealth Director of Public Prosecutors to seek convictions where evidence of wrongdoing is found.

“It is important that people entering into bankruptcy are honest with their trustee and provide accurate information about their financial circumstances,” he warned.

Mr McCosker said a failure to declare the sale or disposal of shares prior to bankruptcy disadvantages genuine creditors.

“Not only is it unfair, it is also illegal,” he said.
