A consumer group has released new data into crypto-assets.

CHOICE has called on the federal government to introduce stronger protections for consumers in the crypto market.

A new survey conducted by the consumer group found that one in nine Australians have purchased crypto such as bitcoin in the last 12 months and one in five are either involved or interested in crypto trading.

Majority of respondents agreed that cryptocurrency trading should have consumer protections similar to trading on the stock market.

CHOICE senior policy advisor, Patrick Veyret, said the number is rising on the back of “aggressive marketing” which often include celebrities and social media influencers.

“The crypto market is booming, but our laws are lagging behind. More and more Australians are purchasing crypto-assets such as Bitcoin and Ethereum without adequate consumer protections,” Mr Veyret said.

“CHOICE is hearing from many Australians about financial loss and other harm caused by purchasing crypto-assets that were not what they appeared to be. We’ve seen a number of recent collapses of exchanges where people have lost all of their savings with no ability to get their money back.”

He continued: “Crypto-assets can be volatile, complex and high-risk products that are causing greater harm to the community as more and more people are risking their livelihoods based on misrepresentations and marketing.”

Mr Veyret has called for action from the government with CHOICE’s research showing a surge in crypto scams and two in five people who are interested are not investing due to the risk of scams.

The government is being called to:

1. Exchanges that sell or are in control of crypto-assets such as Bitcoin need to be subject to strong legal obligations, including a ban on market manipulation.
2. People should have strong consumer protections when purchasing crypto-assets.
3. The new regulatory regime should capture all crypto-asset providers without any loopholes.

“The new federal government needs to rein in the unregulated crypto industry as one of its financial services reform priorities. Australians expect the same level of consumer protection and regulatory oversight for crypto-assets as they do with other financial products,” Mr Veyret said.

“ASIC should also be granted powers to ban certain harmful crypto-assets from being marketed and sold to retail investors.”

In April, ASIC commissioner Danielle Press said the corporate regulator is keen to learn more about the “threats and opportunities” of crypto-assets, and encouraged those in the sector to actively campaign against and interrupt scams.

Meanwhile in March, Minister for superannuation, financial services and the digital economy, Jane Hume, pledged minimalist regulation for the blockchain and crypto sector, saying the government would ensure “fit for purpose, technology neutral” regulation.

CBA has paused the rollout of in-app cryptocurrency trading.

Last November, in a major vote of confidence in crypto-assets, Commonwealth Bank (CBA) announced it would allow its customers to hold and use bitcoin, and other cryptocurrencies via its 6.5 million-user banking app.

“We believe we can play an important role in crypto to address what’s clearly a growing customer need and provide capability, security and confidence in a crypto trading platform," said CBA CEO Matt Comyn said at the time.

“In looking at ways that we can support our customers, we have made the strategic decision to form an exclusive partnership in Australia with Gemini, a global leader with strong security and a track record of serving large institutions,” he added.

However, at the bank’s tech briefing last week, Mr Comyn confirmed that CBA has paused testing amid the global crypto market downturn and regulatory uncertainty.

The CEO noted that following stage one of the pilot, the bank received "some feedback" from customers, which it's currently working through.

“We are also working with a number of regulators very closely, as you would imagine, about the appropriate treatment of this particular product,” Mr Comyn said.

“As events of the last week have reinforced, it is clearly a very volatile sector that remains an enormous amount of interest. But alongside that volatility and awareness and I guess the scale, certainly globally, you can see there is a lot of interest from regulators and people thinking about the best way to regulate that.”

The federal government is consulting on regulation around cryptocurrency, with submission due to close at the end of this week. Speaking at the tech briefing, Mr Comyn suggested that “it will be a focus for the incoming government to think about how to most appropriately regulate the sector”.

“And we want to continue to play a leading role in providing input into that and shaping the most appropriate regulatory outcome. 

“Our intention still, at this stage, is to restart the pilot but there is still a couple of things that we want to work through on a regulatory front to make sure that that is most appropriate,” he said.

Last year, CBA’s move was viewed as a smart ploy to help the big four appeal to young customers and keep pace with rivals such as Square and PayPal, which already allow users to trade and spend bitcoin.

“CBA's move is exciting and inevitable,” Caroline Bowler, CEO of BTC Markets, said at the time.

“It's yet another 'red letter day' for crypto and it is as though Australia has suddenly put the lead foot down.

“We have been touted as playing catch up all this while, but now we're moving into a leadership position globally with our largest bank, and one of the most significant mainstream financial institutions in the world offering millions of customers access to cryptocurrencies.”

European Central Bank president Christine Lagarde has shared her views on the value of crypto and the importance of regulation.

Cryptocurrencies have been deemed “super risky” by the president of the European Central Bank (ECB), Christine Lagarde.

“My very humble assessment is that it is worth nothing. It’s based on nothing, there is no underlying assets to act as an anchor of safety,” Ms Lagarde suggested in an interview with Dutch television on Sunday. 

“I’ve said all along that crypto-assets are highly speculative, very risky assets. If you want to invest there, it’s your choice. But what I’m really concerned about when it comes to crypto-assets is that those investments be made by people who have their eyes wide open about the fact that they can lose it all.”

Ms Lagarde pointed to the recent volatility in crypto markets, which drove a fall of 20 per cent in just one week.

The collapse of the TerraUSD stablecoin sent the market into a panic earlier this month and also raised fears about the potential broader financial implications.

“I’m concerned about those people who assume that it’s going to be a reward who have no understanding of the risks, who will lose it all and who will be terribly disappointed, which is why I believe that that should be regulated,” Ms Lagarde said.

She also distinguished central bank digital currencies (CBDC), including the ECB’s own proposed digital euro, from other crypto-assets.

“The day when we have the central bank digital currency out, any digital euro I will guarantee. So the central bank will be behind it, and I think that’s vastly different from any of those things,” noted Ms Lagarde.

An ECB official indicated last week that the eurozone could be using a CBDC by 2026. 

Former Treasurer Josh Frydenberg previously indicated that the federal government was moving forward on Australia’s first retail central bank digital currency with a pilot program expected before the end of 2022.

Elsewhere, US President Joe Biden signed an executive order on digital assets which included a statement that his administration would place “the highest urgency on research and development efforts into the potential design and deployment options” of a CBDC.

During her interview, Ms Lagarde was also asked whether she herself held any crypto investments.

“No I don’t, because I want to practice what I preach,” she answered, before adding: “I know how it works and I actually have a son who invested in cryptos, yes so I follow it very carefully.”

The collapse of TerraUSD last week sent the crypto market into a panic, raising fears about broader financial implications.

TerraUSD, a stablecoin that is meant to remain pegged to the US dollar, sunk well below its intended value last week, pushing major cryptocurrencies including bitcoin and ether to their lowest levels in months.

An algorithmic stablecoin, TerraUSD uses its sister token Luna to maintain its peg. The two currencies are meant to be swapped in order to reduce or increase the supply of TerraUSD and theoretically bring it back to a value of US$1.

However, TerraUSD lost its dollar peg last week and fell below 10 cents, while Luna dropped to a fraction of a cent from a high of over US$100 in early April. Both have subsequently been delisted from a range of crypto exchanges including the largest by trading volume, Binance. 

“The failure of Terra’s peg has sent shocks through the decentralised finance (defi) sector,” Fitch Ratings said in a note last week.

“There could be significant negative repercussions for cryptocurrencies and digital finance if investors lose confidence in stablecoins. The latter play an important role in catalysing the crypto ecosystem more broadly, by providing a stable link to fiat-currency financial markets.”

AMP chief economist Dr Shane Oliver explained that stablecoins were popular because they allowed crypto traders to trade without having to leave the crypto world, sharing some similarities to money market funds in traditional investment markets.

“But TerraUSD depended on faith in Luna and this was weakened after a series of large withdrawals,” he added.

Alongside falls for the major cryptocurrencies, the world’s largest stablecoin, Tether, also fell to a low of US$0.95. The reserve-backed stablecoin then moved back close to US$1 as the wider crypto market also started to recover.

“Notwithstanding short-term bounces, as with shares further downside is a risk if falls feed on themselves and the speculative mania unwinds leading to yet another 80 per cent top to bottom fall. Or buy and HODL may kick in again,” Dr Oliver suggested. 

“With little in the way of fundamental value it's hard to know which way it goes.”

Dr Oliver noted that cryptocurrencies have recently been behaving like a high beta version of shares. 

“Like tech stocks, they benefited immensely from easy money and ultra low interest rates and bond yields,” he said.

“So now that easy money is being reversed they are suffering along with tech stocks albeit more so as there was far more hot air involved in cryptos.”

eToro global markets strategist Ben Laidler argued that extreme sell-offs were not new to the crypto market.

“We have seen such situations in the past, and the market could well rebound quickly or slowly (or not at all),” he said.

“Global retail investor ownership of crypto is already big, broad, and resilient to volatility, per our Retail Investor Beat survey. A focus now is whether institutional investors, who have been slowly building positions in this new asset class, take advantage of current price weakness to step up their involvement."

Looking ahead, Dr Oliver said that a crypto crash may have a more lasting impact and affect the ability of cryptocurrencies to attract more investors.

“For the broader financial system and economy a crypto crash poses a risk (particularly if the cash and other US dollar assets supposedly backing stablecoins like Tether have to be sold) but it's unlikely to be another sub-prime crisis,” Dr Oliver added.

“Banking system exposure to crypto is limited and the exposure of the wider investing public is still small (contrary to various surveys claiming the contrary – but which seem more aimed at marketing interest in cryptos). Demand for Lamborghinis may suffer a set back though.”

According to Fitch Ratings, the risk of crypto volatility causing wider instability would be limited due to the weak link between crypto markets and regulated financial markets.

“However, many regulated financial entities have increased their exposure to cryptocurrencies, defi and other forms of digital finance in recent months, and some Fitch-rated issuers could be affected if crypto market volatility becomes severe,” the firm said.

“There is also a risk of an impact on the real economy, for example through negative wealth effects if crypto-asset values fall steeply. Nonetheless, we view the risks to Fitch-rated issuers and real economic activity as being generally very low.”

UNSW Sydney has received the largest known cryptocurrency donation to an Australian higher education institution.

Ethereum co-founder Vitalik Buterin has gifted crypto worth $5.3 million to UNSW to support the advancement of an open-source artificial intelligence tool (OSINT) providing pandemic early warning signs.

The funds will be used to establish the Shiba Inu OSINT Initiative, funded by Buterin’s Balvi Filantropic Fund and led by UNSW’s Kirby Institute, which will oversee the evolution of EPIWATCH and its dissemination to low and middle-income countries.

EPIWATCH, developed by UNSW Kirby Institute’s Professor Raine MacIntyre, harnesses open-source data and uses artificial intelligence to create early warnings. 

It works by scanning millions of items of publicly available online data, such as social media and news reports, for early signals of epidemics.

According to UNSW, due to its ability to scan vast amounts of data in real time, the tool can pick up on developments much quicker than formal reporting protocols through doctors and laboratories.

“Imagine if someone had detected COVID-19 before it spread around the world – that is our vision,” said Prof. MacIntyre.

“Using AI and real-time open-source data, EPIWATCH does not depend on people making reports. It is a great equaliser and can overcome weak health systems and censorship.”

Prof MacIntyre underlined the importance of making EPIWATCH accessible to low and middle-income countries.

“To be most effective, it needs to be accessible in local languages and used widely at the grass roots level down to villages and small towns around the world. This will give us the best prospect of preventing pandemics,” said Prof. MacIntyre.

The gift from the Balvi Filantropic Fund is UNSW’s first crypto gift and is believed to be the largest crypto gift accepted by an Australian higher education institution. 

Commenting on his latest undertaking, Mr Buterin said: “Open analysis of public data is an excellent alternative to more intrusive forms of monitoring, which are also often only available to governments and other high bidders but closed to the public”.

“By contrast, an open source and open access approach that allows researchers, including members of the public, to work collaboratively across the world can be more easily improved and scaled to detect new pandemics wherever they begin.”

The hope is that the Shiba Inu OSINT Initiative could avert future world crises like pandemics.

The new crypto-based ETFs have been launched on the Cboe Exchange.

Cboe Australia has confirmed that three crypto-based ETFs will launch on its exchange on Thursday after previously suffering delays.

The ETFS 21Shares Bitcoin ETF (EBTC) will become the first Australian ETF to invest directly in bitcoin, while the ETFS 21Shares Ethereum ETF (EETH) will be the first to invest directly in ether.

The two funds were due to list on 27 April but Cboe later indicated that “standard checks prior to the commencement of trading” still needed to be completed just before the original launch date.

ETF Securities chairman Graham Tuckwell said that launch was the culmination of months of hard work and that both ETFs were “true firsts for Australia”.

“The market capitalisation and trading volumes for these two leading cryptocurrencies are now larger than any company listed on the Australian stock exchanges, yet investors have not been able to gain access to them in a regulated manner,” he said.

“By offering this access through an ETF, investors can now gain portfolio exposure to these crypto-currencies in an institutional-type way.”

Cboe Australia CEO Vic Jokovic said that the firm was pleased to have partnered with ETF Securities to bring the first crypto ETFs to market in Australia.

“EBTC and EETH are breakthrough products that will pave the way for more Australians to expose their portfolios to cryptocurrency in a regulated manner,” he said.

“We are committed to providing Australians with access to best-in-class technology and innovative investment solutions, and ETF Securities’ decision to quote EBTC and EETH on Cboe Australia is a testament to that commitment.”

Additionally, the Cosmos Purpose Bitcoin Access ETF (CBTC) will also launch on Thursday after suffering a similar delay.

This fund will provide investors with bitcoin exposure by investing in the world’s first physically settled bitcoin ETF, the Canada-based Purpose Bitcoin ETF.

Cosmos Asset Management CEO Dan Annan described the launch as a significant milestone for crypto in Australia.

“CBTC is a fund-of-funds and invests directly in the $1.7 billion world first spot Bitcoin ETF, the Purpose Bitcoin ETF,” he said.

“This gives investors a secure and easy way to introduce cryptocurrency to their asset allocation mix using the same tried-and-tested process they are already well acquainted with, and in a liquid and well-regulated market.”

Mr Jokovic commented that investors seeking crypto-asset exposure stood to benefit from the recent influx of crypto-backed ETFs.

“We’re excited to introduce the Cosmos Purpose Bitcoin Access ETF to Australian investors,” he said.

“By bringing CBTC to market on Cboe Australia, Cosmos is making Bitcoin accessible to investors in a secure and recognisable structure, all underpinned by the first physically settled Bitcoin ETF in the world.”

All three ETFs will commence trading on Cboe Australia on Thursday, 12 May, and will be available through Cboe Australia market participants and supporting Australian stockbrokers.
